1. Overview
newscene.ai (“NewScene,” “we,” “us,” or “our”) is committed to protecting your personal data. This Privacy Policy describes how we collect, use, disclose, and safeguard information when you access newscene.ai (the “Service”). It applies to all users regardless of location.
This notice explains our practices; it does not ask you to consent to every use of data. Optional analytics and marketing choices are separate from our Terms of Service. NewScene operates from California.
You can manage optional analytics through Privacy choices, request a copy of your data, or request account deletion from your profile. Contact us if you cannot sign in.
2. Data We Collect
2.1 Information You Provide
- Account data: name, email address, and password (hashed) when you register.
- Profile data: avatar, display name, and other optional profile fields you choose to add.
- Payment data: billing address, payment method type, and last four digits. Full card numbers are handled exclusively by our PCI-DSS-compliant payment processor (Stripe) and are never stored on our servers.
- User Content: videos, images, audio, text, and project data you upload or create using the Service. You own this content; we hold it on your behalf.
- Communications: messages you send us via email or support channels.
- AI prompts: text prompts you submit to AI generation features. These may be processed by third-party AI providers (see Section 4).
2.2 Information Collected Automatically
- Log data: IP address, browser type, operating system, referring URL, pages visited, and timestamps of access.
- Device data: device type, browser information, and screen resolution when needed for service functionality or when optional analytics is enabled.
- Usage data: features used, export counts, session duration, and editor interactions used to improve product functionality.
- Cookies and similar technologies: session tokens, preference cookies, and analytics identifiers (see Section 5).
2.3 Information from Third Parties
- OAuth providers: if you sign in via Google or another OAuth provider, we receive your name and email address as provided by that service.
- Payment processors: confirmation and status of transactions from Stripe.
3. How We Use Your Data
We use the data we collect to:
- Create and manage your account and authenticate your sessions.
- Provide, operate, and maintain the Service — including rendering and storing your video projects.
- Process payments and manage subscriptions.
- Respond to support requests and communicate service-related information.
- Send necessary account, security, and billing messages. Any optional promotional email requires a separate choice and an unsubscribe method.
- Analyze usage patterns to improve product performance, reliability, and new features.
- Detect, investigate, and prevent fraudulent or prohibited activity and enforce ourTerms of Service.
- Comply with legal obligations and enforce our legal rights.
Legal bases (for EEA/UK users): We process personal data on the basis of contract performance (providing the Service you requested), legitimate interests (security, product improvement, fraud prevention), legal obligation (compliance), and — for marketing communications and optional analytics — your consent. You may object to processing based on legitimate interests, subject to applicable law.
4. Data Sharing
Providing the Service involves sharing relevant data with the recipients described below. Optional Google Analytics is disabled until you choose to enable it.
4.1 Service Providers
We disclose the data necessary for vendors to provide the features you use. Depending on their role, vendors process data on our behalf or for their own legal obligations, such as payment-fraud prevention. Categories include:
- Cloud hosting & storage (application hosting, file storage, and delivery providers)
- Payment processing (Stripe)
- AI content generation (including Atlas Cloud and the model providers used by the selected feature). Prompts and relevant uploaded images, video, or audio may be sent to those providers; avoid uploading sensitive information that is unnecessary for the task.
- Email delivery (transactional and marketing email providers)
- Analytics (Google Analytics, only after your optional analytics choice; event and device data may be personal data, even where reports are aggregated)
- Error monitoring (crash reports and performance traces)
4.2 Legal Requirements
We may disclose your data if required by law, subpoena, court order, or governmental authority, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
4.3 Business Transfers
In the event of a merger, acquisition, sale of assets, or other business transaction, your data may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Service prior to your data being transferred and becoming subject to a different privacy policy.
4.4 With Your Consent
We may share your data with third parties when you have explicitly consented to that sharing.
5. Cookies & Tracking Technologies
We use necessary storage for sign-in, security, and remembering your privacy choices. Optional Google Analytics is off until you accept it. You can reject it without losing access to the Service, or change your selection using Privacy choices in the footer or your profile. We also recognize Global Privacy Control as a sale/sharing opt-out signal.
Our Cookie & storage policy describes these technologies. Withdrawing analytics permission stops future collection; to request removal of historical personal data, use the privacy request methods below. Clearing browser storage may remove saved choices; optional analytics then defaults to off again.
6. Data Retention
We keep account and project information while needed to provide the Service, subject to the storage and expiry rules of your plan. Canceling a subscription does not by itself delete your account. Permanent account deletion ends NewScene access and starts removal of account data, projects, uploads, generated media, and related working files.
We may retain limited records where necessary for tax, accounting, payment disputes, security, legal claims, or documenting privacy requests and communication opt-outs. Retention depends on the record's purpose and applicable obligations; these exceptions do not justify keeping all your creative content. We explain relevant exceptions when responding to a deletion request.
Backup copies may remain until the backup retention cycle expires and must not be used to restore a deleted account to service. Copies held by providers follow their roles, deletion processes, and applicable legal retention obligations. Files you downloaded or shared outside NewScene are outside our control. Contact us for details about your request.
7. Security
We use account authentication, access controls, and password hashing where passwords are used to help protect personal data. No service can guarantee absolute security. Report suspected unauthorized access to [email protected]. We assess security incidents and notify affected people and authorities when applicable law requires it, within the deadlines that apply to the incident.
8. Your Rights
Depending on your location you may have the following rights regarding your personal data:
- Access: request a copy of the personal data we hold about you.
- Rectification: request correction of inaccurate or incomplete data.
- Erasure (“right to be forgotten”): request deletion of your personal data, subject to legal retention requirements.
- Restriction: request that we restrict processing of your data.
- Data portability: receive your data in a structured, machine-readable format.
- Objection: object to processing based on legitimate interests or for direct marketing purposes.
- Withdraw consent: where processing is based on consent, withdraw it at any time without affecting the lawfulness of prior processing.
California Residents (CCPA/CPRA)
Where the CCPA applies, California residents have the right to know what personal information is collected, the right to delete, the right to correct, the right to opt out of the “sale” or “sharing” of personal information, and the right to non-discrimination for exercising these rights. Use Privacy choices for tracking preferences. To submit a rights request or act as an authorized agent, contact us at [email protected].
EEA & UK Residents (GDPR / UK GDPR)
Where GDPR or UK GDPR applies to our processing, you have the applicable rights under that law. You also have the right to lodge a complaint with your local supervisory authority (e.g., the ICO in the UK, or your national Data Protection Authority in the EU).
To exercise any of the above rights, contact us at [email protected]. You can also use the privacy controls in your profile for export and account deletion. We respond without undue delay and within the applicable legal deadline, generally one calendar month under GDPR and 45 days for covered California requests. We notify you if a permitted extension is needed. We may proportionately verify identity before disclosing or deleting personal data. You do not need an account to contact us. If you disagree with a response, reply requesting a review or appeal; this does not limit regulator complaints.
9. International Data Transfers
newscene.ai operates globally and your data may be transferred to and processed in countries other than the country in which you reside, including the United States, where our primary infrastructure is located. These countries may have data protection laws that differ from your own.
Where applicable law restricts international transfers, a valid transfer mechanism is required, such as an adequacy decision or approved contractual safeguards. Contact us for information about the recipients and safeguards relevant to your data.
10. Children’s Privacy
NewScene accounts and use of the Service are for adults aged 18 and older. We do not permit people under 18 to create an account. If you believe a person under 18 has created an account or supplied personal data as a user, please contact us at [email protected] and we will promptly delete the account information, subject to any legal requirements.
11. Third-Party Links & Services
The Service may contain links to third-party websites or integrate with third-party services (e.g., social media sharing, OAuth providers). We are not responsible for the privacy practices of those third parties, and this policy does not apply to them. We encourage you to review the privacy policies of any third-party services you use.
12. Changes to This Policy
We may update this Privacy Policy periodically to reflect changes in our practices, legal requirements, or Service functionality. When we make material changes, we will update the “Last updated” date at the top and, for registered users, provide notice via email or a prominent in-product notification at least 14 days before the changes take effect.
Changes to this notice do not override your saved choices. We seek a new choice where a change in processing requires new consent.
